How long do I have to file a Notice of Appeal?

A Notice of Appeal must be filed within 30 days (including weekends and holidays) of the time-stamp date of the entry of the judgment that is being appealed. A Notice of Cross-Appeal must be filed within 10 days of the e-Filing of the first Notice of Appeal. A Notice of Appeal from any other trial court (Municipal, External linkFranklin County Probate, or the Ohio Court of Claims) must be filed with their respective Clerk. That Clerk will transfer the Notice of Appeal to the Clerk of the Tenth District Court of Appeals for filing. After a Notice of Appeal has been filed, the Clerk of Courts for the Tenth District Court of Appeals will serve notice of the filing to the counsel of record of each party other than the appellant, or if a party is not represented by counsel, to the party at their last known address.

What is the Record on Appeal?

The Record on Appeal consists of all original papers and exhibits filed in the trial court, a certified copy of the docket and journal entries prepared by the Clerk, and any transcripts of proceedings before the trial court. Please note, transcripts of trial court proceedings will only be included in the Record on Appeal if the appellant has requested the transcripts from the court reporter, the court reporter has prepared the transcripts (normally the appellant must pay to have the transcripts prepared) and filed the transcripts with the Clerk of the trial court.

When will the clerk transmit the record?

The Record on Appeal is normally transmitted 40 days after the filing of the Notice of Appeal, unless the appellant has requested and been granted an extension of time to transmit the record. A motion for an extension of time to transmit the record due to the court reporter’s inability to prepare the transcript within 40 days must be accompanied by an affidavit from the court reporter indicating when the court reporter will have the transcript completed and filed.

What is the deadline for filing my brief?

The time for filing briefs depends on the appropriate case calendar. On the regular calendar, the appellant has 20 days from the date on which the Clerk transmits the Record on Appeal to file their brief. The appellee’s brief is due 20 days from the filing of appellant’s brief, and a reply brief is due 10 days from the filing of the appellee’s brief. Cases on the accelerated calendar require the appellant's brief filed 15 days from the date on which the Clerk transmits the Record on Appeal. The appellee’s brief is due 15 days from the filing of appellant’s brief; filing of a reply brief is not permitted with this trial calendar. How do I file an Original Action?

You may either e-File your complaint, mail pleadings to the Clerk of Courts office with required payment, or deliver it to Clerk of the Tenth District Court of Appeals for filing in the Clerk of Courts office.
